Q465. Is an offshore petroleum and natural gas production facility that reported to BOEM's (formerly BOEMRE) most recent OCS emissions inventory (formerly GOADS) that did not exceed the combined emissions threshold for subparts C and W sources of more than 25,000 metric tons CO2e required to report GHG emissions for the current GHGRP reporting year if emissions exceed this threshold?

A465.  If the facility's emissions in the current reporting year are 25,000 tons CO2e or more for all sources covered by the greenhouse gas reporting rule (GHGRP), in this case sources under subparts C and W, then the facility must report.

For Reporting Year (RY) 2024 and earlier, 40 CFR 98.233(s)(1)(ii) also indicates that if the calendar year does not overlap with the most recent BOEM (formerly BOEMRE) emissions study publication year, the reporter must use the most recent BOEM reported emission data and "adjust emissions based on the operating time for the facility relative to the operating time in the most recent BOEMRE published study."  Therefore, if the emissions reported to the most recent Outer Continental Shelf (OCS) emissions inventory (formerly the Gulfwide Offshore Activity Data System), adjusted for any differences in the operating time for the current GHGRP reporting year, equal or exceed 25,000 metric tons CO2e, then the facility must report for the current reporting year.

For RY 2025 and later, per 40 CFR 98.233(s)(1)(i), offshore production facilities must report their emissions as calculated using BOEM's most recent monitoring and calculation methods, provided BOEM's OCS AQS is available and the facility has the necessary data to do so. Scaling emissions reported in a past year using a ratio of operating hours is only allowed if OCS AQS is unavailable or the facility lacks the data to use BOEM's methods, per ยง 98.233(s)(1)(ii).

Note: The Bureau of Ocean Energy Management (BOEM) and the Bureau of Safety and Environmental Enforcement (BSEE) replaced the Bureau of Ocean Energy Management, Regulation and Enforcement (BOEMRE) in October 2011.  Additionally, BOEM has replaced the GOADS database with the Outer Continental Shelf Air Quality System (OCS AQS) beginning with its 2021 emissions inventory. The applicable regulatory citation is now 30 CFR 550.302 through 304 instead of 30 CFR 250.302 through 304.
