A490. The definition of facility in 40 CFR 98.6 requires equipment to be under “common ownership or common control.” While the fuel gas lines may have a different owner, if these gas lines serve only the gas processing plant, they could be considered under common control of the gas processing facility. If the facility is unsure whether the fuel gas lines may be considered under common control, the owner/operator should seek an applicability determination from the EPA considering the specific circumstances at the facility.
