A588. The provisions of 40 CFR 98.2(a)(3)(iii) do not apply to subpart W because the applicability requirements of 40 CFR 98.2(a)(2) are reference by 40 CFR 98.231(a). To determine subpart W applicability, you must determine if you meet the requirements of 40 CFR 98.2(a)(2) and/or 40 CFR 98.231(a)(1) through (4). Emissions from flare stacks must be included in the applicability determination for facilities in all petroleum and natural gas systems industry segments except natural gas distribution and onshore natural gas transmission pipelines because flare stacks are included under subpart W for these industry segments per the applicable paragraphs in 40 CFR 98.232.
